Rush Smith, colored, has been sentenced at Lebanon, Russell county, Va., to serve five years in the State penitentiary for shooting David Kiser at Gravel Lick, in that county, in April. Smith and Kiser became involved in a quarrel over the settlement of a whiskey sale, when the former drew a pistol and fired a bullet into the latter's head, putting out one eye and passing through the brain. Feeling against Smith was very bitter at the time of the shooting, and a lynching was narrowly averted.
